This is the question most riders ask first. The answer is: it depends on where you ride and your scooter type — but the legal landscape is moving firmly towards mandatory insurance nationwide.

Under Spanish traffic law, electric scooters are classified as Vehículos de Movilidad Personal (VMP) — personal mobility vehicles. Royal Decree 970/2020 and subsequent DGT (Dirección General de Tráfico) regulations have progressively tightened the rules. Several major cities — including Madrid, Barcelona, Seville, and Valencia — have introduced local ordinances requiring third-party liability insurance as a condition of riding on public roads.

A 2023 DGT directive signalled the government's intention to make third-party liability insurance mandatory for all VMP nationwide. Even in areas where it is not yet legally enforced, riding without insurance is a serious financial risk. If you cause an accident and injure a pedestrian or damage a vehicle, you could face a personal liability claim running to tens of thousands of euros — with no insurer to cover it.

What the Law Says About Riding Electric Scooters in Spain

Beyond insurance, there are several important rules every rider should know:

  • Maximum speed: 25 km/h on public roads and cycle lanes
  • Where you can ride: Cycle lanes and, where these do not exist, the road. Pavements are prohibited.
  • Motorways and fast roads: Strictly prohibited
  • Helmets: Not legally required for adults on cycle lanes, but strongly recommended — some municipalities require them
  • Alcohol limit: The same 0.5g/l blood alcohol limit applies as for other vehicles
  • Passengers: Carrying a passenger is prohibited on a single-person scooter
  • Mobile phones: Using your phone while riding is illegal and carries a fine
  • Age: Riders must be aged 15 or over

Fines for traffic violations on electric scooters can range from €100 to €500. Riding without mandatory insurance where it is required can result in fines up to €3,000.

What Does Electric Scooter Insurance Cover?

Accidental Damage

Covers physical damage to your scooter caused by accidents, falls, collisions, or vandalism. Particularly useful if you have a premium model.

Personal Accident Cover
