Yes. Under Spanish traffic law (Ley sobre responsabilidad civil y seguro en la circulación de vehículos a motor), every motorised vehicle must have at least third-party liability insurance — including mopeds, scooters, and motorcycles. This applies even if the vehicle is parked in a garage and not being ridden. Riding without insurance is an offence that can result in fines of €601 to €3,005 and seizure of the vehicle.
The legal minimum. Covers damage and injury you cause to other people and their property. Does not cover damage to your own scooter. This is the cheapest option and is suitable for older, lower-value mopeds where the cost of repair or replacement is relatively low.
Adds theft, fire, roadside assistance, and legal defence to your third-party cover. This is the most popular choice for scooter owners — theft is a real risk in Spanish cities, and having roadside assistance is invaluable if you break down.
