Yes. Under EU Regulation 2019/947 (which Spain adopted in full), third-party liability insurance is mandatory for all drone operators flying in the Open Category — which covers the vast majority of recreational and hobbyist flights. The regulation applies regardless of the drone's weight, though practical insurance thresholds often begin at drones weighing more than 250g.

Spain's AESA (Agencia Estatal de Seguridad Aérea) enforces drone regulations and carries out spot checks. Flying without insurance is classified as a serious infringement under Spanish aviation law, with fines ranging from €3,001 to €60,000 depending on the severity.

Beyond fines, the bigger risk is uninsured liability. If your drone causes property damage or injures a person, you are personally responsible for all costs. A single personal injury claim could exceed €100,000.

Understanding the Drone Categories in Spain

Spain follows the EU's three-category classification for drone operations. Understanding your category determines what training, registration, and insurance you need:

Open Category (A1, A2, A3)

Covers most recreational and hobbyist flights. Divided into three subcategories based on drone weight and proximity to people:

  • A1 — Drones under 250g. Can fly near people but not over crowds. Minimal training required.
  • A2 — Drones 250g–2kg. Must maintain 30m horizontal distance from uninvolved people (or 5m with low-speed mode). A2 CofC certificate required.
  • A3 — Drones 250g–25kg. Must fly at least 150m from residential, commercial, industrial, and recreational areas.

Third-party liability insurance is mandatory for all subcategories.

Specific Category

For operations that fall outside the Open Category — e.g. flying closer to people, beyond visual line of sight (BVLOS), or in controlled airspace. Requires an operational authorisation from AESA and higher insurance limits.

Certified Category

Reserved for high-risk commercial operations. Treated similarly to manned aviation. Comprehensive insurance required.

What Does Drone Insurance Cover?

Drone insurance in Spain typically comes in two main forms:

Third-Party Liability (Responsabilidad Civil)

The legally required minimum. Covers damage or injury you cause to third parties — people, vehicles, property, or other aircraft. Coverage limits typically start at €750,000 and go up to €5,000,000 or more for commercial operators. This is the cover you need to comply with EU Regulation 2019/947.

Comprehensive Drone Cover (Hull Insurance)

Covers damage to your drone itself — crashes, fly-aways, water damage, and in some cases, theft. Particularly recommended for higher-value drones such as DJI Mavic 3, DJI Air 3, or Autel Evo II, where replacement costs can exceed €2,000.

Some policies also include:

  • Personal accident cover for the pilot
  • Equipment cover (controllers, spare batteries, carrying cases)
  • Loss of income cover for commercial operators
  • Cover for first-person view (FPV) drones

How Much Does Drone Insurance Cost in Spain?

Drone insurance is one of the most affordable speciality covers available:

  • Recreational third-party liability only: From €30–€80 per year
  • Third-party + hull (recreational): €80–€200 per year depending on drone value
  • Commercial operator cover: €150–€500+ per year depending on operation type, coverage limits, and annual flying hours
