
Civil Liability Insurance in Spain: What It Is and Why You Need It
Civil liability insurance (seguro de responsabilidad civil) is one of the most important — and most misunderstood — types of insurance in Spain. In simple terms, it covers you if you are legally responsible for causing injury to someone or damage to their property. Without it, you could be personally liable for tens of thousands of euros in compensation and legal costs.
What Does Civil Liability Insurance Cover?
Civil liability (RC) insurance covers:
- Bodily injury to third parties — if someone is injured because of something you did (or failed to do), your RC insurance covers their medical costs, loss of earnings, and compensation for pain and suffering.
- Property damage to third parties — if you damage someone else's property, your insurance covers the repair or replacement costs.
- Legal defence costs — your insurer covers the cost of defending you in court, even if the claim is ultimately found to be unjustified.
Where Does Civil Liability Come Up in Daily Life?
More often than you might think:
- Water leak from your flat — by far the most common RC claim in Spain. A burst pipe or overflowing washing machine in your apartment damages the property below. You are liable for all repair costs to their property, furniture, and decoration.
- Your dog injures someone — if your pet bites someone or causes them to fall, you are liable. Spain requires civil liability insurance for certain breeds (perros potencialmente peligrosos), but any dog can cause an incident.
- Your child breaks something — parents are liable for damage caused by their minor children. A football through a neighbour's window, accidental damage in a shop, injury to another child at school.
- Cycling or e-scooter accident — if you hit a pedestrian while cycling or riding an electric scooter, you are personally liable for their injuries.
- DIY work gone wrong — you attempt to fix something in your property and accidentally damage shared infrastructure or a neighbour's wall.
Types of Civil Liability Insurance in Spain
Personal / Family Civil Liability
Covers you and your family members for incidents in daily life — at home, on the street, while doing sports, etc. Often included as part of your home insurance policy, but the amount of cover varies significantly. Check that the amount is adequate (minimum €300,000 recommended).
Professional Civil Liability (RC Profesional)

Property Owner Civil Liability
Included in your home insurance. Covers claims arising from your property — someone slips on your wet terrace, a tile falls from your balcony, a tree in your garden falls onto a neighbour's car.
Is Civil Liability Insurance Mandatory in Spain?
It depends:
- Vehicle insurance — mandatory (third-party liability is the legal minimum for all motorised vehicles)
- Professional liability — mandatory for regulated professions (doctors, lawyers, architects, etc.)
- Dangerous dog breeds — mandatory RC insurance of at least €120,000
- Hunting — mandatory RC insurance for all hunters
- General personal liability — not legally mandatory but strongly recommended
Even where not mandatory, the cost of NOT having it can be devastating. A single serious injury claim can run into hundreds of thousands of euros. Premiums for personal RC cover are typically just €30–€80/year as part of a home insurance policy.
How Much Civil Liability Cover Do You Need?

- Professional liability — depends on your profession and turnover, typically €150,000 to €600,000
